DriveNow Financing — Terms and Conditions

1. Acceptance of these Terms

These Terms and Conditions (“Terms”) apply to your use of https://drivenow.vibepreview.app (the “Site”) and the services of DriveNow Financing, operated by DriveTown Ottawa (1850420 Ontario Inc.) (OMVIC registration 5265954), 4871 Bank St, Ottawa, ON (“DriveNow Financing”, “we”, “us” or “our”). By using the Site or submitting a financing application, you agree to these Terms, our Privacy Policy and our SMS Terms (if you opt in to texts). If you do not agree, please do not use the Site.

2. What DriveNow Financing does

DriveNow Financing helps residents of Ontario apply for vehicle financing and find a vehicle that fits their situation. We:

  • collect and review your financing application;
  • with your authorization, submit it to lenders we work with; and
  • help you review any financing offer and complete a vehicle purchase.

We are not a lender and we do not make credit decisions. Approvals, interest rates, terms, down-payment requirements and contracts are set solely by the lender.

3. No offer of credit

Nothing on the Site is an offer of credit, an approval or a commitment to lend. Financing available, conditions apply. All financing is on approved credit (OAC) and depends on the lender’s review of your credit, income, employment, residency, down payment, co-applicant (if any), the vehicle selected and the lender’s own criteria. Submitting an application does not mean you will be approved, and we do not promise any rate, payment, term, approval or timeline. Any examples on the Site are for illustration only. The full cost of borrowing, including the interest rate and all fees, will be disclosed by the lender in your financing agreement before you sign.

4. Eligibility

To use the Site and apply, you must:

  • be at least the age of majority in your province (18 in Ontario);
  • live in Ontario;
  • have the legal capacity to enter into a contract; and
  • apply for yourself, or with the knowledge and consent of any co-applicant whose information you provide.

5. Accuracy of the information you submit

You agree that all information you provide is true, accurate, current and complete, and you will tell us promptly if it changes. Providing false, misleading or incomplete information may lead to your application being declined, ending our services, and legal consequences where applicable. We and the lenders may verify the information you provide. We may decline to proceed with any application at our discretion.

6. Credit-review authorization

A credit report is obtained under the one required consent box on our application. By giving that consent, you authorize DriveTown Ottawa (1850420 Ontario Inc.) (DriveNow Financing) and the lenders it works with to obtain your credit report and verify the information you have provided, to review your financing application.

7. Communications

We will contact you about the request you submit. One required box on our application covers the credit authorization, your agreement to the Terms and Privacy Policy, and our contact with you by phone, text and email about your application; you must tick it to submit your application. The exact wording is:

“I authorize DriveTown Ottawa (1850420 Ontario Inc.), operating as DriveNow Financing, and the lenders it submits my application to, to obtain my credit report and other consumer reports and to verify the information I provided, to assess this application and arrange vehicle financing. This may include a credit inquiry on my credit file. I agree to the Terms and Privacy Policy, and I agree that DriveNow Financing may contact me by phone, text and email about this application. Msg & data rates may apply. Reply STOP to stop texts, HELP for help. You can withdraw your consent anytime by replying STOP or emailing info@easydrivecanada.com; if you withdraw before your application is processed, we may not be able to complete it.”

Marketing texts and emails are a separate optional box that is not required to apply or to buy a vehicle, and you can withdraw it at any time by replying STOP to any text, using the unsubscribe link in any email or emailing info@easydrivecanada.com. See our SMS Terms and Privacy Policy.

8. No financial advice

Information on the Site is general information only. It is not financial, legal, tax or credit advice. Before signing, review every financing agreement and vehicle purchase document carefully, and seek independent advice if you need it.

9. Acceptable use

You agree not to: use the Site for any fraudulent, misleading or unlawful purpose; submit another person’s information without their permission; interfere with the Site’s security or operation; or copy, scrape or misuse Site content.

10. Third parties

Lenders, credit bureaus, dealers and other third parties act independently and are responsible for their own decisions, services and communications. Their terms and privacy policies apply to what they do. We are not responsible for a third party’s decision to approve or decline credit or for the terms it offers.

11. Limitation of liability

To the maximum extent permitted by law, DriveTown Ottawa (1850420 Ontario Inc.), its directors, officers, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of opportunity, arising from your use of the Site, credit decisions made by lenders, delays or errors in processing, or interruptions in data transmission. Nothing in these Terms limits any right you have under the Ontario Consumer Protection Act or any other law that cannot be excluded by contract.

12. Indemnity

To the extent permitted by law, you agree to indemnify DriveTown Ottawa (1850420 Ontario Inc.) against claims, losses and expenses that result from false or misleading information you submit, your breach of these Terms, or your misuse of the Site.

13. Intellectual property

The Site’s content, including text, the DriveNow Financing name and logo, graphics and software, belongs to DriveTown Ottawa (1850420 Ontario Inc.) or its licensors and may not be copied or used without written permission.

14. Suspension

We may suspend or end access to the Site or our services at any time for conduct that breaks these Terms or the law.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to any law that gives you the right to bring a claim where you live, disputes will be resolved in the courts of Ontario.

16. Language

These Terms are provided in English.

17. Changes to these Terms

We may update these Terms. The current version, with its “Last updated” date, will always be on this page. Changes apply from the date they are posted and do not affect an application already submitted.
